Directive 2006/42/EC

The Machinery Directive 2006/42/EC is a set of regulations from the European Union that specifies safety and health requirements for machinery and other related products. Manufacturers and businesses involved in supplying these products in Europe must comply with these requirements to market or use their machinery within the EU. This involves ensuring that their products meet the essential safety standards outlined in the directive. Only when these and other relevant CE product requirements are fulfilled can the products be labeled with the CE mark. This mark allows them to be freely sold and used across the European Union.

The directive covers a variety of equipment including machinery, installations, interchangeable equipment, and several other product categories. However, certain products like agricultural and forestry tractors are not covered by the Machinery Directive. These exclusions are specific to the directive and these products must meet other relevant standards as applicable.

Looking ahead, the Machinery Directive will be updated by the new Machinery Regulation (EU) 2023/1230. This upcoming regulation, which aims to modernize and streamline the existing rules, will replace the directive. The regulation emphasizes enhancing safety features, clarifying obligations for economic operators, and introducing stricter requirements for machinery incorporated with artificial intelligence. This transition to a regulation ensures that the rules become directly applicable across all EU member states without needing transposition into national law, promising a more uniform application of safety standards.

Six steps to CE certification of Machinery & Installations

1. Product classification

Determine whether the product falls within the scope of the Machinery Directive and/or other CE Directives.

2. Risk assessment

An analysis to determine the risks and essential health and safety requirements applicable to the relevant machinery.

3. Conformity procedure

Assessment of requirements established in step 2 in accordance with Harmonised European standards.

4. Technical Documentation

Verify the Technical Documentation containing descriptions, instruction manuals and the performed risk assessments.

5. EU Declaration of Conformity

Verify certificates and draw up the EU Declaration of Conformity in order to confirm compliance of the machinery/installation with CE legislation.

6. CE marking

Instructions on correctly affixing the CE marking to the machinery or installation.
