Can I sell products before completing CE marking?

No, you cannot legally sell products in the EU/EEA while CE marking is still in progress if they fall under a CE-regulated category. You must complete the conformity assessment, create a technical file, and physically affix the CE mark before placing the item on the market.

If your product requires CE marking (such as toys, electronics, machinery, or PPE), selling it before the process is complete is illegal.

What happens if you sell early?

• Marketplace bans: E-commerce platforms (like Amazon or Bol) frequently scan listings and will immediately block or remove products that lack the necessary CE mark and valid documentation.
• Enforcement actions: European market surveillance authorities can force you to recall the products, issue fines, or halt imports at customs.

The Few Exceptions

• Prototypes & Fairs: You can display uncertified products at trade fairs, exhibitions, or demonstrations, provided you place a visible sign stating that the product does not yet comply with EU regulations and cannot be sold until it does.
• Non-CE Products: If your product does not fall under specific EU harmonization directives (e.g., most general textiles, furniture, or cosmetics), it does not need a CE mark. However, it must still comply with the general safety requirements under the GPSR.
